Terms and Conditions of Sales

Introduction
ACP Ceramics provides pottery wares which are food, microwave and dishwasher safe to her customers in a timely method of delivery chosen by the customer. Payment is due at time of purchase of single orders. This document uses the following terms:
- Artist, ACP Ceramics, Ashley Padgett Ceramics - The Artist Ashley Caroline Padgett, her Company, and official representatives of her Company.
- Work, Piece, Ware, Item - A physical object created by the Artist.

Guarantees and Refund Policy
Items are guaranteed free from defect upon delivery.

Defective items, which are cracked or broken on delivery receipt, may be refunded without returning
the item, upon approval from ACP Ceramics, with a digital photograph of the item(s) with the
packaging materials clearly depicting the defective product(s) and any contributing damage from
the shipping materials. The photo must be emailed to ashley.c.padgett@gmail.com.

Non-defective items are returned at cost to the customer up to 30 business days from receipt.
Upon receiving the item back, the refund will issued in 1-2 business days.

Approved refunds are issued within 1-2 business days using the payment method provided for the
original sale. In the event a refund is not accepted by the issuing bank after 10 business days,
a check will be issued.

Custom Orders
The payment, payment schedule, guarantees, and policies governing custom orders are unique to each order
as outlined in the Custom Order Agreement. However, ACP Ceramics adheres to certain policies for all
custom orders.

Custom orders are accepted by ACP Ceramics at her discretion;
however, ACP Ceramics does not reject custom orders based on a customer’s race, color, religion
or creed, national origin, gender, sexual orientation, age, physical or mental disability, or
veteran status.
- In the development phase, the artist will work with her client to develop pottery wares.
Communications with artist will be through email allowing for 1-2 business days between communications if needed.
Once a line of work has been agreed, artist and client will sign a contract.
The artist will stay in contact with customer to maintain open communication and timeline updates.
Half payment of custom order and any past bills must be paid before production begins.
Customer may ask for changes but can be denied based on previous contract if changes greatly alter
timeline or character of work.
Upon completion of the order, the artist will contact her client for final payment before shipment.

- Custom order may not be returned for refund.

Right to Decline
ACP Ceramics reserves the right to decline any order to any customer except for reasons based on the
customer's race, color, religion or creed, national origin, gender, sexual orientation, age, physical
or mental disability, or veteran status.

Shipping
Every reasonable effort will be made to ensure the customer receives their purchased work using their chosen shipping method. Orders are processed within 1 to 2 business days except in cases where the Artist or Shipping Manager are unavailable.
- When the Artist or Shipping Manager will be unavailable to fulfil orders, a notice will be displayed on the website and checkout before an order is placed.

Shipping Vendor Returns for Failed Delivery.
Orders returned to the Artist by the Shipping Vendor for delivery failures as result of inaccurate or incomplete delivery address, or in cases where the customer was unable to accept the delivery; the order will be refunded less the expended shipping fees.

Copyright
Unless explicit permission has been granted for a specific use, all work purchased through custom order,
trade show, craft fair, art sale (et. al) from ACP Ceramics are copyright Ashley Carolina Padgett.
Duplication of her work, in whole or in part, is strictly prohibited.
- Distribution of any photograph or facsimile of this work should clearly indicate the Artist’s Name.
- All work, visual depictions, descriptions on the Artist’s website, unless explicitly indicated otherwise, is the copyright Ashley Caroline Padgett.

Privacy Policies
ACP Ceramics holds your privacy in the highest regard. These policies outline what information we collect
and how we use it; however, we do not sell or give your data to any outside company, partner, or affiliate.

What we collect to create an order.
In the process of creating an order on our Websites or through an in-person transaction we require:

Your name and address (or the name and address of the shipping recipient) which we use
to process and ship your order.

Your email address. We use your email to provide notifications about your order.

The last four digits of your credit card, the brand (Visa, MasterCard, Discover, etc…)
of your credit card, and your card’s expiration date. We use this information to show you
which credit card was used for each order.

What we collection during the normal use of our sites.
We use information about our web visitors’ technology so we can ensure the technology used on
our site is a good match. We also track which pages you visit on our sites which we use to understand
how you and others interact with our site and products in hopes we can improve our site and products.
We provided anonymized information about your web visit to a 3rd party service to help our analysis.

What we do not collect.
We do not collect your full credit card number - your credit card number is directly provided to
our credit card processor. Our site never knows your credit card number nor do we store your credit
card number.

This contract is governed by the Laws of the State of South Carolina.
